MACC panel clears Shahrizat
KUALA LUMPUR: The Malaysian Anti-Corruption Commission (MACC) Operations Review Panel (PPO) yesterday cleared Datuk Seri Shahrizat Abdul Jalil of any wrongdoing over the National Feedlot Corporation (NFCorp) issue.
PPO chairman Tan Sri Dr Hadenan Abdul Jalil said the investigations had approached the case on two aspects; on whether Shahrizat was involved in the process of getting the RM250 million soft loan and whether she was also involved in the awarding of the contract for the National Feedlot Centre.
"After further investigations, we found that Shahrizat had nothing to do with the awarding of the RM250 million loan," he said.
The national feedlot scandal first came to light in the 2010 Auditor-General's Report, which indicated that there were weaknesses in the corporation in achieving its objectives. In 2007, the government approved a RM250 million soft loan to the corporation at two per cent annual interest to enable the corporation to start a national feedlot centre to reduce beef imports but NFC's assets had been frozen since.
Shahrizat's husband, Datuk Seri Dr Mohamed Salleh Ismail, is the chairman of NFCorp.
On March 12, Salleh was charged in the Kuala Lumpur Sessions Court with two counts of committing criminal breach of trust involving a total of RM49.7 million and two counts of violating the Companies Act. Salleh had pleaded not guilty to all four counts.
He was also accused of banking in RM40 million into his company National Meat and Livestock Corporation Sdn Bhd's (NMLC) account and purchasing two condominium units in Bangsar for RM9,758,140 in 2009.
Shahrizat resigned as women, family and community development minister on April 8 but she remained Wanita Barisan Nasional and Wanita Umno chief.

NEW INFORMATION: MACC advised to pursue case under 2009 probe papers
KUALA LUMPUR: THE Malaysian Anti-Corruption Commission's (MACC) Operations Evaluations Panel yesterday said it has instructed the commission to reopen the corruption probe into Azmin Ali.
Panel chairman Tan Sri Dr Hadenan Abdul Jalil said, after chairing a meeting at the MACC Academy here in Jalan Duta, that MACC was advised to pursue the case under the 2009 investigation papers as the information they had was incomplete.
MACC had revived the case in 2009 when Anuar Shaari, who was Datuk Seri Anwar Ibrahim's private secretary, came forward with new information eerily similar to the contents of the missing file concerning Azmin's case.
"The case happened a long time ago and in the view of the panel, this happened at a time when the old act was still enforced.
"However, the case was reopened in 2009 when new information was given to the MACC.
"The most tedious part is that because this is an old case, we found that the information was incomplete and needs to be added on.
"Getting evidence will be a challenge, but the MACC will make all the efforts to ensure that the case is solved as soon as possible."
MACC investigations head Datuk Mustafar Ali explained that the initial investigations in 1995 had found that Azmin and his wife had amassed expensive property without any explainable reason.
However, the Anti-Corruption Agency, as the commission was known then, was unable to act against him as there was no such provision in the Prevention of Corruption Act 1961 to prosecute public servants who were living beyond their means.
The provision only came into existence in 1997 with the Anti-Corruption Act and later, with the Malaysian Anti-Corruption Commission Act 2009.
Mustafar said there was no issue on pursuing a case despite it being first investigated 17 years ago as there was no time limit constraints.
Hadenan also said that no action was taken as there was no issue of corruption according to the laws available then.
"There are legal issues which need be settled by the MACC."
Mustafar added the MACC would have to re-look at the totality of the information it has on the case as Azmin had acquired his wealth before the new act was in place.
Hadenan also didn't discount the possibility when asked whether the MACC would contact the former director-general of the ACA and other officers involved in the investigation, adding that this would prove to be a challenge as well as some of them may have moved away or have died since then.
Mustafar said there had been occasions where the commission pursued cases involving public servants living beyond their means.
He cited a case in 2007, where the individual was prosecuted under the Anti-Corruption Act 1997 and another in 2011 under the Malaysian Anti-Corruption Commission Act 2009.
In an exclusive report by the New Straits Times yesterday, former ACA director-general Datuk Shafee Yahaya said he had recommended to Anwar, who was then deputy prime minister and finance minister, ****that disciplinary action be taken against Azmin following a 1995-97 probe into alleged corruption.
He had said the probe revealed that Azmin was deep in debt.
Highly placed sources told the NST that Azmin had been investigated for, among others, assets allegedly amassed with his wife, Shamsidar Taharin, including houses and cars totaling almost RM1.5 million, shares valued at hundreds of thousands of ringgit, and almost RM10 million in cash and cheques that went in and out of both their accounts that had been certified by the banks concerned.
The assets were allegedly acquired when Azmin served as Anwar's private secretary. His pay then was RM2,442 a month.
Parti Keadilan Rakyat came to Azmin's defence when strategic director Mohd Rafizi Ramli and Keadilan Wanita chief Zuraida Kamaruddin issued a joint statement yesterday which outlined several "facts" of the case based on Shafee's book The Shafee Yahaya Story.
They said Shafee had stated in his book on pages 306, 326 and 256 that there were no elements of corruption found in the investigation that warranted the allegations against him in 1995.
"He (Shafee) also stated the ACA had recommended that disciplinary action be taken against Azmin in line with government regulations."
On a separate note, Hadenan told reporters the investigation into allegations of illegal sand mining in Selangor involving PKR assemblymen Mat Suhaimi Shafiei (Sri Muda) and Amirudin Shari (Batu Caves) was officially closed.
The panel had in February, instructed the MACC to re-visit the case.
Present were panel members Datin Aminah Pit Abd Raman, Prof Dr Syed Noh Syed Ahmad and Walter Sandosam.
