Shafee gets show cause letter over alleged professional misconduct

KUALA LUMPUR: Senior lawyer Tan Sri Muhammad Shafee Abdullah (pic) has been issued a show cause letter by the Bar Council over allegations of professional misconduct.
Muhammad Shafee is said to have been sent the letter for his participation in a road show following Datuk Seri Anwar Ibrahim's sodomy conviction.
Malaysian Bar president Steven Thiru confirmed Tuesday that a show cause letter had been issued to the lawyer over the allegations.
“Yes, we have issued a show cause letter. The details of allegations in all disciplinary matters are confidential and I am therefore unable to comment on the contents of the show cause notice,” he said.
When pressed further, Steven said, “Yes, all disciplinary actions are for professional misconduct. I cannot go into details of the type of professional misconduct for reasons of confidentiality.”
On Feb 10, lawyer Tommy Thomas and former Court of Appeal judge Tan Sri V.C. George had proposed a motion seeking to discuss Muhammad Shafee’s conduct in defending Anwar’s conviction via a series of roadshows at the Malaysian Bar AGM on March 14.
On March 13, Muhammad Shafee filed a defamation suit against the Bar Council as well as Thomas, George and former Malaysian Bar president Christopher Leong over the matter.
He also obtained an ex-parte injunction to prevent the Bar from discussing his conduct in relation to Anwar’s sodomy case at its AGM or any other date thereafter.

DESIDERATA: I can only add that press reports sighted before today had reported on the lawyer going on UMNO-organised roadshows during which ****(SEE report below...)MUHammad SHAfee REPORTEDLY EVEN REVEALED EVIDENCE FROM THE TRIAL WHICH WAS GIVEN "IN CAMERA" and HENCE COULD NOT BE SHARED WITH THE PUBLIC!
JUST also add that events in MALaysia in the recent months are building up to what I would term a GATHERING STORM. Later, if the GODs are kind to the RAKyat, the climax would see a PERFECT STORM which would result in a REGIME CHANGE AND SOME of the CULPRITS RESponsible for moving our dear beloved country towards the ABYSS would get the JUSTICE THE COUNTRY and its RAKyat DESERVE.
KEep wellA, GBless awe the GOOD people of NEgaraKU, many who in the past few months have become brave enough to STAND UP AND BE COUNTED. ~~ YL, DESI, knottyaSsusual

Gobind Singh Deo, who represented Anwar in the Federal Court appeal, said this following claims that prosecutor under fiat Tan Sri Muhammad Shafee Abdullah had revealed details of in-camera proceedings during a public forum last week.

“It was clearly expressed (in the proceeding notes) by the trial judge (Datuk Mohamad Zabidin Mohd Diah) that such matters must not be reproduced,” said Gobind.
“As such, the attorney-general should state if his office had committed contempt of court as the order was made in the presence of then former solicitor-general II Mohd Yusof Zainal Abiden and it was pronounced in open court.”
According to the notes of the court proceedings made available to Malay Mail, Mohamad Zabidin had said: “I would like to remind parties here that today’s proceeding is in camera, that means whatever evidence adduced stays within these four walls.”
He said although Shafee only appeared on behalf of the prosecution at the appeal level, he would have known about the matter through the records.

“The attorney-general must explain the matter as any lawyer who takes over a case at the appeal stage would have known about this.”
On whether Shafee, a veteran lawyer, should be hauled up by the Bar’s disciplinary board over his conduct, the Puchong MP said: “Markers must now be put in place as to the conduct of private lawyers who are asked to prosecute in cases. It is important to set the record straight.”
Malaysian Bar president Christopher Leong had earlier yesterday said the directions or terms made with regards to any proceeding held in camera could only be ascertained through the notes of court proceedings.
Leong said in a statement “there is no place for roadshows and debates”.
“Any roadshow or public debate by a prosecutor with respect to a prosecution he had conducted culminating in a conviction, would add nothing to the conduct of the prosecution, proceedings or conviction, but may potentially embarrass or affect public confidence in or perception of the office of the public prosecutor,” he said.
Leong’s statement on the public disclosure was supported by lawyer Lim Lip Eng.
“I am delighted to read the Bar Council’s response that confirms there certainly should be no place for roadshows or debates (for court cases).
