Desi SPIES A PERFECT STORM FORMING IN THE NEAR HORIZON...

I have writtten about 1MDB under a few major headings the past few months  eg WHY I Say Malaysia is heading towards the ABYSS: the UNRAVELLING OF 1MDB; and A GATHERIING STORM Over Malaysia, and all the choruses seem to be building up TO A STUNNING CRESCENDO.

IN THE past few days the  LIGHTNING FLASHES Have Been MORE CUTting; the THUNDER CLAPS have been more DEAFENING. ALl the signs that a PERFECT STORM IS Forming in the NEAR HORIZON,  AND THE DARKEST CLOUDS ARE mostly centred on PUTRAJAYA, and the CHIEF TENANT OF THE HOUSE OF UMNO/(DENMARK) IN EX-PM DR MAHATHIR MOHAMAD'S WOrds of wisdom, is IN A PANIC MODE, Behaving like a drowning man clutching at the last straw.

Its President, Datuk Akhbar Satar, claimed that continuity of the probes is definitely disrupted by the changes made by Prime Minister Datuk Seri Najib Razak's administration ― which include the removal of ministers seen critical of Putrajaya's handling of 1MDB and the sudden termination of Tan Sri Abdul Gani Patail as Attorney-General (AG).
Akhbar stressed that Najib himself had pledged in April to make public the findings of the Auditor-General's audit of 1MDB's dealings and that the federal government will not accept “any abuse of power in 1MDB”.
“What has happened to date is directly opposite to the PM’s declaration – will the people now know or it is only for certain persons’ own consumption and filed in the cupboard?” Akhbar said in a statement.
On Tuesday, Najib removed Tan Sri Muhyiddin Yassin as deputy prime minister and education minister in what is seen as a culling of ministers who are said to have broken ranks in the ongoing 1MDB fiasco.
The reshuffle also brought in four members of the Public Accounts Committee (PAC) as new additions to the federal administration, potentially stalling a separate probe on 1MDB by the parliamentary committee.
Just hours before the Cabinet reshuffle was announced, Chief Secretary to the Government Tan Sri Ali Hamsa issued a statement announcing the termination of Abdul Gani's tenure as AG for “health reasons”.
Up to the point of his removal as AG ― which took effect on July 27 ― Abdul Gani was heading a multi-agency taskforce probing allegations of misappropriation linked to Najib and 1MDB.
Akhbar today stressed that the public cannot be blamed for taking a negative view of the situation with so much change having happened in such a short span of time.
“Given the snail pace of the investigations and halting of PAC activities coupled with the sackings on 29 July, how will intelligent Malaysians view the whole episode?
“Surely they will think it is clearly a concerted effort to stop the probe into 1MDB in its tracks,” he said, adding that it is not helped by the three-month suspension of The Edge Weekly and The Edge Financial Daily over their coverage of 1MDB.

Disputing newly-appointed Attorney-General Tan Sri Mohamad Apandi Ali’s statement issued today, PKR’s Latheefa Koya pointed out that Abdul Gani had been — until his unceremonious removal on Monday — the head of a special taskforce probing 1Malaysia Development Bhd (1MDB).
As Attorney-General, Abdul Gani would have been the sole arbiter on the conduct of criminal prosecutions.
“Firstly, the authenticity of the draft charge sheet must be confirmed or denied by Tan Sri Gani himself. Gani was in charge of the investigations and was the key member of the 1MDB task force.
“In the public interest, it is hoped Tan Sri Gani Patail will come forward to clarify this matter,” she said in a statement today.
Latheefa also disputed Apandi’s claim that the draft charge sheets were evidence of a plot to topple Datuk Seri Najib Razak as prime minister, saying it was premature to arrive at such an assumption.
Putrajaya has cried political sabotage ever since the Wall Street Journal’s exposé claiming that US$700 million (RM2.6 billion) was diverted from 1MDB into the prime minister’s personal accounts.
“The AG must not jump to conclusions by claiming that there is a plot to topple the PM simply because of the appearance of this alleged charge sheet. Where is the evidence for such a plot?” Latheefa said in a statement.
Apandi today declared the documents published by Sarawak Report to be false and corroboration of Putrajaya’s claim of a conspiracy to criminalise the prime minister in a bid to force his exit from office.
This came after he declined to comment yesterday when asked to confirm the authenticity of the papers published by the UK-based whistleblower website.
Pictures of the document had been published yesterday by whistleblower site Sarawak Report, which claimed to have obtained a copy of corruption charges that were in the final stages of being drafted by Tan Sri Abdul Gani Patail against Najib and one other person connected to the 1MDB controversy.
Abdul Gani was abruptly removed as AG in an announcement by the Chief Secretary to the Government Tan Sri Ali Hamsa on Tuesday, ostensibly due to health concerns.
However, the Sabah-born who served as AG nearly 13 years since January 2002 told Malay Mail Online that he had not been aware of his removal until the announcement.
Up to then, Abdul Gani was part of a multi-agency government taskforce investigating claims of misappropriated funds involving Najib and 1MDB.

It is all too apparent that Prime Minister Najib Razak’s lightning move to remove the Attorney General and reshuffle his cabinet on July 28 was done for the singular purpose to neuter criminal investigations and impending prosecution arising from the 1MDB scandal and the RM2.6 billion in Najib’s personal bank accounts.
By removing AG Gani Patail and offering cabinet positions to members of the PAC (parliamentary account committee), Najib hopes to avert impending prosecution and postpone imminent PAC hearings on key players in 1MDB, which in all certainty, will expose the massive multi-billion heist that will grievously hurt Najib.
SACKING OF AG HIGHLY DUBIOUS
The so-called sacking of Gani is heavily tainted with unconstitutionality, illegality, deceit and malicious intent.
The circumstances of the announcement immediately aroused suspicion. It was announced on July 28 by national news agency Bernama through a one-sentence  tweet stating that Gani’s services as AG was terminated on July 27 due to health reasons, quoting the Chief Secretary of the government.
When asked on July 28, Gani said he had no idea that he had been sacked.
Questions galore: Why wasn’t Gani informed? Why wasn’t there a letter of termination from the Head of State Agong, who is the only authority to appoint or to remove the AG? If Gani had to stop work due to health reasons, why were we told that Gani would still continue to serve as a legal staff till his statutory retirement date in coming October? And why had Gani never complained of ill health?  And why didn’t PM Najib announce that he had “sacked” Gani?
As the AG is designated by the Constitution as the sole decision-maker as to whether a person should prosecuted, the independence of his position is guaranteed by mandating his termination through a tribunal appointed by the Agong. Hence, the currently unceremonious “dumping” of Gani is obviously an unconstitutional move.
SABOTAGING INVESTIGATIONS AND PROSECUTIONS
Conspiracy theories abound as to why Najib had to act like a desperado. Is it to avert an immediate prosecution which only the AG had the power to execute – keeping in mind that there have been a series of arrests arising from the investigations of the Special Task Force probing the twin scandals of Najib’s RM2.6 billion and the 1MDB fiasco?  The task force is made up of the chiefs of police, MACC and Bank Negara, co-ordinated by the AG.
Another body hot on the heels of these scandals is the PAC, which is due to grill the current and former CEOs of 1MDB starting from Aug 4, and also to hear two former directors of 1MDB who resigned in indignation over the theft of US$700 million immediately after signing a bogus joint venture agreement with PetroSaudi in September 2009.
Immediately after the cabinet reshuffle on July 28, where PAC chairman Nur Jazlan and three other members were offered positions in the cabinet, Nur announced a suspension of PAC hearings pending appointment of new members in the next parliamentary session commencing in October.
Thus in one lightning swoop, Najib had apparently incapacitated the pursuers of the scandals and immunise himself from harm, and perhaps hopefully, to bury these scandals.
If Najib succeeds, Malaysians will have to bury their heads in shame, and the credibility of this country will suffer a grievous and irreparable blow.
Who would still trust a country where the prime minister can escape unscathed with unaccounted for RM2.6 billion in his bank accounts and tens of billions of ringgit of public funds evaporated into thin air through a so-called sovereign wealth fund, of which he is personally responsible?

Can our institutions – the police force, the anti-corruption commission MACC, Central Bank and the attorney general’s chambers – stand the shame of being cowed and neutered by a tyrannical hand in contempt of our constitution and law?  

MUST DEFEND AGAINST TOTALITARIANISM
No, we must not allow this to happen, because we have too much too lose and too much to defend.
The Special Task Force must continue to discharge its sacrosanct duties honourably and diligently until the whole truth is uncovered and the culprits punished – with or without Gani Patail as AG.  They owe this to themselves and to the future generations of Malaysians.
As for the PAC, it should immediately resume hearings under the leadership of deputy chairman Dr.Tan Seng Giaw who shall act as chairman in the absence of Nur Jazlan.  With 9 remaining members in PAC (out of a total of 13), there is more than enough members to make up a quorum (minimum is 3).
This is the hour when all Malaysians must stand up to defend themselves against an onslaught, which if not repulsed, will turn the country into a failed state of corrupt dictatorship.

KUALA LUMPUR - Amid plunging public confidence and a massive sell-off in the Malaysian shares and currency markets, Opposition Members of Parliament unanimously agreed to adopt demands made by NGOs and social activists following news that Prime Minister Najib Razak had allegedly 'bought' the country's 13th general election held in May 2013, and had some RM2.6 billion of 1MDB-linked funds illicitly transferred to his personal accounts.
"Najib has become a tremendous liability to Malaysia, yet his Umno party refuses to chastise him or take action to restore confidence such as demanding he go on leave to allow for a neutral probe," MP for Batu Tian Chua told Malaysia Chronicle.
"This sort of attitude and corruption are no longer tolerated by the people or investors and Umno must heed the wishes of the people or be held culpable for helping Najib destroy Malaysia's economy."
The Opposition MPs, led by PKR president Wan Azizah and DAP adviser Lim Kit Siang, had gathered at Parliament house this morning in a meeting that Najib's office had tried to foil by cancelling their booking for a meeting room.

Electoral watchdog Bersih 2.0 will lead Malaysians in an overnight street rally from August 29 to 30 to call for Prime Minister Datuk Seri Najib Razak's resignation over his handling of 1Malaysia Development Bhd (1MDB), the group announced today.

Its chairman, Maria Chin Abdullah, said the rally – to be held Kuala Lumpur, Kuching and Kota Kinabalu –  would also demand for institutional reforms to end "prime ministerial corruptions" which it said had begun since the time of former prime minister Tun Dr Mahathir Mohamad.

"All Malaysians are now paying a huge price for the RM42 billion scandal of 1MDB among other incidences of corruption, leakage and mismanagement.
"We invite all patriotic Malaysians to join the rally to demand for Najib to step down and the institutional reforms to be implemented so as to end prime-ministerial corruption," she said.
Maria, speaking at a press conference in Petaling Jaya today, said Najib was covering up alleged corruption and had crushed the people's hopes for justice and integrity.
"Najib is taking every possible move to protect corruption. He arrogantly ignores the humble wish of Malaysians for integrity and justice. He has lost every ounce of legitimacy to stay in office," she said.
Dubbed the "Bersih 4" rally, the coming demonstration will be the movement's fourth. Its earlier rallies in 2007, 2011 and 2012 were to press for electoral reform.
Maria noted recent "political moves" by Najib which "virtually ruled out all possibilities for truth on the 1MDB scandal to be unearthed and criminals to be brought to justice".
These were changes to the cabinet as announced by Najib yesterday, as well as the removal of Attorney-General Tan Sri Abdul Gani Patail.
She said replacing Gani, while he was in the midst of probing 1MDB as a member of a special government task force, was "meant as a warning signal to the other three agencies" in the team.
She added that Gani's removal was being rejected or questioned by many parties who had doubts over its constitutionality.
Another move to prevent the truth about 1MDB from being uncovered, Maria added, was the **** "co-optation" (DESi believes the right word here is COOPTION, YL)of four members of Parliament's Public Accounts Committee (PAC) by promoting them into the government administration.
"As PAC members cannot be holding executive positions, these appointments are Najib's unscrupulous plot to disable PAC, the only other public institution which is pursuing the 1MDB scandal with the support of the Auditor General's Office."
Maria also said Najib was concentrating power in himself by appointing Home Minister Datuk Seri Ahmad Zahid Hamidi as deputy prime minister, noting that Zahid had just ordered the suspensions of The Edge publications for exposes on the 1MDB scandal.
"That Najib and Zahid simultaneously hold two powerful ministries of Finance and Home Affairs depletes any hope of independent investigations without more attempts to cover up corruption and silence critics," she said. – July 29, 2015.

Why I say Malaysia Is Moving Towards the Abyss...


The Impending Unravelling of IMDB could lead towards the UNRAVELLING OF NAJIB RAZAK, described by many quarters as the "weakest PM" Negaraku ever had, including by none-other-than Dr Mahathir Mohamad -- love or hate hime PM who ruled Malaysia for 22 years, no joke! As a journalist-blogger for past 10 years, Desi takes Mahathir seriously, at least he quotes Shakespeare occasionally! Mahathir's nemesis now in-jail-on-trumped-up-sodomy-charges second time around, Sdr Anwar Ibrahim -- also quotes Shakespeare often enough, more than the good doctor around the Putajaya house!

Now the Opposition Leader once oppressed by Mahathir, continues to be persecuted by the current UMNO regime, but Anwar's salvation may come from a surprising quarter -- from the infighting within UMNO. The almigthy Vitamin M may save Najib from the EGM called by his "bodeking" division heads/supporters for tomorrow, but the looming national crisis brought on by the falling world oil prices, (and casuing Petronas to report its first loss of some RM8billion in the closing quarter of 2014), and the concurrent dwindling ringgit excahnge rate, is now compunded further by the UNRAVELLING OF THE FIVE-YEAR OLD 1MALAYSIA DEVELOPMENT BERHAD.

THE GATHERING STORM Over Malaysia: PART II

OF All the THUNDERCLAPS HEARD yesterday, I was hit by an "UNUsual" Lightning strike which at the time of HAPPENING, DESI was awestruck. WHY LAH, MR NAJIB, TAKE OUT THE ATTORNEY-GENERAL, GANI PATAIL?

TO My mind, after all moUrn of RUMINATION AT BF AND LUNCH TODAY< DESI was trying to solve the puzzle: all along since the 1MDB ISSue broke onto the MALAysian horizon several months ago, GANI had behaved admirably after doing a wonderful job with the help of a conscripted private sector lawyer SHafee somebody putting DS ANWAR IBRAHIM IN SUNGAI BULOh PRison. 

AMIDST ALL THE MINISTERIAL SACKINGS, GANI'S REMOVAL DID NOT MAKE SENSE!
THEN I MET up wit' my BUDdhist Matey at LIDo,  he believes it's KARMA COMing home to roost.

AG not part of probe team, says task force

Attorney-General Abdul Gani Patail was never part of the investigators in the special task force probing the allegations surrounding 1MDB, including RM2.6 billion being deposited into the prime minister's private bank accounts. (DESI's knotty thinking aloud: REALLY? AFTER functioning for weeks?)

The special task force said this in a joint press statement today signed by Bank Negara governor Zeti Akthar Aziz, inspector-general of police Khalid Abu Bakar and Malaysian Anti-Corruption Commission (MACC) chief Abu Kassim Mohamed.

"The special task force would like to clarify that the investigation is handled by the MACC, police and Bank Negara as the investigating agencies.

"The issue of Abdul Gani (photo) as attorney-general interfering and influencing the investigations does not arise.

"Instead, Abdul Gani is only referred to for guidance and legal advice to ensure the investigation is holistic and according to law," said the task force.

It was responding to reports which called for Abdul Gani to be excluded from the special task force.

This was the first statement by the task force which was only signed by the three investigating chiefs.

Gani Patail’s removal as AG reckless and unconstitutional — Eric Paulsen

JULY 28 — Lawyers for Liberty views with extreme concern the sudden removal of Attorney General Gani Patail by the Prime Minister in a wide ranging reshuffling move that included members of his Cabinet. While it may be the PM’s prerogative to appoint and remove members of his Cabinet, the position of the AG is governed by the Federal Constitution.

Under article 145(6) of the Constitution, the AG’s security of tenure is protected and he “shall not be removed from office except on the like grounds and in the like manner as a judge of the Federal Court.”

Under article 125(3) of the Constitution, a federal court judge (and therefore the AG) can only be removed through a tribunal that is appointed by the Yang di-Pertuan Agong for breach of code of ethics, inability, infirmity of body or mind or any other cause, to properly discharge the functions of his office.

The sudden removal of Gani Patail as the AG at the whim of the PM is shocking to say the least, and can only fuel public suspicion of interference, that this was done in bad faith as he had then headed the high level task force investigating the massive 1MDB scandal that is currently engulfing the PM’s administration.

We call on the PM not to act recklessly and in contravention of the Constitution. If Gani Patail is unable to properly discharge the functions of his office, the right thing to do is to set up a tribunal in accordance with the Constitution, so that he can properly defend himself against any charges and if warranted, he can so be removed.

Cabinet reshuffle: Ahmad Zahid is new DPM, Muhyiddin dropped

PUTRAJAYA: Datuk Seri Dr Ahmad Zahid Hamidi (pic) has been appointed Deputy Prime Minister.
He replaces Tan Sri Muhyiddin Yassin.
In announcing the Cabinet reshuffle on Tuesday, Prime Minister Datuk Seri Najib Tun Razak said that the decision to drop Muhyiddin was a tough one but necessary so that the Cabinet was united.

Media groups to rally over Edge suspension

Media groups will be organising a rally to protest Putrajaya's suspension of two newspapers under The Edge Media Group for exposing alleged misappropriation of funds in finance ministry-owned 1MDB.

The announcement was made in a joint statement by Gerakan Media Marah (Geramm), Institute of Journalists (IoJ), Reporters Sans Frontieres (RSF), Centre for Independent Journalism (CIJ), and Foreign Correspondents Club of Malaysia.

"In light of the recent developments, as groups representing the journalistic profession, we the undersigned have collectively gathered as a coalition to condemn the Home Ministry’s decision to suspend The Edge Weekly and The Edge Financial Daily's publishing permits for three months effective July 27," it said.

The coalition said the rally will take place on Aug 8 and will be backed by the public and civil society in Kuala Lumpur, but the exact location has yet to be finalised.


It added that a solidarity rally will also be held outside The Edge headquarters in Petaling Jaya on July 31 at 3pm.

"To the media, this is an issue that should affect us all. We are all #AtTheEdge.

"What has happened to The Edge is not something new and will not be the last, unless all of us collectively speak up against such acts," it said.

Freedom of information

The Edge had alleged that US$1.83 billion of 1MDB's funds was siphoned away in its joint venture with PetroSaudi International.

This is based on information - including email correspondents belonging to PetroSaudi - that was allegedly stolen by its former director Xavier Andre Justo.

The Edge owner Tong Kooi Ong had admitted to misleading Justo in order to obtain the information without paying him as demanded, citing public interest.

The media coalition said while it acknowledged the ethical debates behind how the information was obtained, it also highlighted the need for media to be given fair access to information, such as in the 1MDB case.

"It is time to move from a regime of Official Secrets to one of Freedom of Information, whereby information should by default be a public right.

"We demand a stop to political intervention in media affairs and that media access to information that is of interest to public is not hindered either by law or process," it said.

Accompanied by graphics headlined “Press Freedom, A Pillar for Democracy,” the Petaling Jaya-based taxi app company recounted on its Facebook page how it received the support of the media when it first started and the importance of press freedom.
“To our friends in the mainstream and alternative media, you have our support. We recognise the role you play in shaping our country.
“Let’s all put our differences aside and take a stand for Freedom of the Press, one of the key cornerstones of democracy. #speakup, it read.
In three hours, the post received 330 likes with commenters offering their own personal support for the message.
This follows the Home Ministry’s suspension of the two publications starting last Monday.
In a letter to the publisher, the ministry cited their reporting on 1MDB as “prejudicial or likely to be prejudicial to public order, security or likely to alarm public opinion or is likely to be prejudicial to public and national interest.
Before that, online access to London-based Sarawak Report was blocked by the Malaysian Communications and Multimedia Commission (MCMC) two weeks ago.
